If your Draper item develops a fault then please email admin@toolden.co.uk with your order number, Draper part number and details of the issue (along with photos if possible) and we will contact Draper directly to resolve this for you.

If the item is to be collected then Draper will email you the labels required and advise you of the collection details.

 

Terms of Business

All genuine Draper products carry the quality guarantees shown in the Terms of Business below.

 

Condition of the Goods and Warranty

(i) The Seller warrants that on delivery, and for a period from the date of delivery as specified in the manufacturer’s guarantee period below (the warranty period), the goods shall:

(a) conform in all material respects with their description and any applicable specification, and

(b) be free from material defects in design, material and workmanship.

(ii) The terms implied by sections 13 to 15 of the Sale of Goods Act 1979 are, to the fullest extent permitted by law, excluded from the contract.

(iii) Buyers must ensure that goods are suitable for the purpose intended.

(iv) Subject to (v) below, if the Buyer gives notice in writing to the Seller during the warranty period within a reasonable time of discovery that some or all of the goods do not comply with the warranty set out above, and the Buyer (if asked to do so by the Seller) returns such goods to the Seller’s place of business at the Buyer’s cost, the Seller must be given a reasonable opportunity of examining such goods. The Seller shall, at its option, repair or replace the defective goods, or refund the price of the defective goods in full. The remedies set out in this paragraph shall be the Buyer’s sole remedies for any breach of the warranty in (i) above and any other claim in relation to the condition of the goods.

(v) The Seller shall not be liable for the goods’ failure to comply with the warranty set out above if:

(a) the defect arises because of a failure to follow the Seller’s instructions as to the storage, commissioning, installation, use and maintenance of the goods or (if there are no instructions) good trade practice regarding the same; or

(b) the Buyer alters or repairs such goods without the written consent of the Seller; or

(c) the defect arises as a result of fair wear and tear, wilful damage, negligence, or abnormal storage or working conditions; or

(d) the goods differ from their description or specification as a result of changes made to ensure they comply with applicable statutory or regulatory requirements or continuous improvement.

 

Guarantees (From Date of First User Purchase)

(i) Draper Tools offers the following manufacturer’s warranties to end users that purchase goods from the Buyer:

*We offer a free 3 year warranty on Draper Expert hand held power tools. Registration is required. For further information, please see www.drapertools.com/warranty-registration.

This warranty does not apply to normal wear and tear the product undergoes in its lifetime, or damage caused by misuse, careless or unsafe handling, alterations, accidents, or repairs attempted other than by authorised Draper warranty repair agents. These warranties are in place of any other warranty, expressed or implied, and variations of such warranties are not permitted, but your statutory rights are not affected.

Exclusions to LIFETIME WARRANTY include but are not limited to consumable products (ie; drill bits, abrasive wheels, sanding sheets, batteries, PPE and clothing etc), Hex, RIBE® and Draper TX-STAR bits, hinged joint extension handles. Repair kits will be issued for most ratchets. Torque wrench testing and re-calibration must be carried out on a regular basis to ensure accuracy.

(ii) Any power tool described above and considered faulty must be returned to our warranty department at Draper Tools Limited, Hursley Road, Chandler’s Ford, Eastleigh, Hampshire, SO53 1YF. To arrange collection, please contact +44 (0)23 8049 4041 or +44 (0)23 8049 4046. Alternatively, it may be returned to our nearest authorised warranty repair agent if so directed by your Draper Tools area sales manager. If the tool is found to be faulty, it will be replaced or repaired at the Seller’s discretion free of charge, or a full credit will be given.

(iii) Any other tool considered faulty must be returned to Draper Tools at the address given above with a written statement confirming the fault. If the tool is found to be faulty, it will be repaired or replaced at the Seller’s discretion free of charge, or a full credit will be given.

(iv) The warranties in this clause do not apply to the Buyer.

 

Limitation of Liability

(i) Nothing in these Terms of Business shall limit or exclude the Seller’s liability for:
(a) death or personal injury caused by its negligence, or the negligence of its employees, agents or subcontractors (as applicable);
(b) fraud or fraudulent misrepresentation;
(c) breach of the terms implied by section 12 of the Sale of Goods Act 1979;
(d) defective products under the Consumer Protection Act 1987; or
(e) any matter in respect of which it would be unlawful for the Seller to exclude or restrict liability.

(ii) Subject to (i) above, the Seller shall under no circumstances whatsoever be liable to the Buyer, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profit, or any indirect or consequential loss arising under, or in connection with, the contract governed by these Terms of Business.

(iii) The Seller’s total liability to the Buyer in respect of all other losses arising under, or in connection with such contract, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the price of the goods.
